Expressões em latim no inglês jurídico
Na coluna, Ex officio : Ex-officio? (clique aqui), traçamos um breve histórico do papel do latim no inglês jurídico e levantamos os problemas decorrentes da tradução dessas expressões para o português.
No português jurídico, assim como no inglês jurídico, há uma abundância de expressões latinas. Entretanto, apesar de essas expressões serem oriundas do 'latim', elas passaram pelo filtro de uma outra língua e se tornaram parte do português e do inglês.
Como resultado, na tradução, temos casos em que :
1) Uma mesma expressão de origem no latim é usada por ambas as línguas, porém com acepções diferentes. É o caso de inter partes.
2) Certas expressões em latim em uma língua não são usadas em latim na outra. Por exemplo, erga omnes em português.
3) Diferentes expressões em latim são usadas para expressar uma mesma acepção em duas línguas diferentes. É o que ocorre com rebus sic stantibus em português e ceteris paribus em inglês.
