As colocações de judgment – Parte 3

Dando seguimento ao tema, abaixo mais dez colocações do termo judgment.

21. final appealable judgment – "We conclude that the trial court's judgment is not a final appealable judgment because it is conditioned on the future completion of numerous actions. We dismiss the appeal for lack of a final judgment."1 Tradução: sentença recorrível

22. final judgment – "The final judgment in his case hasn't been entered because federal prosecutors and Scavo's attorneys are still squabbling over money -- exactly how much of his ill-gotten gains Scavo must forfeit." Tradução: sentença [de primeira instância] (Nota: em regra irrecorrível, mas não necessariamente)

23. foreign judgment"Although statutes governing the recognition of a "foreign judgment" generally contemplate a judgment granting or denying recovery of a sum of money, the Uniform Act does not prevent the recognition or non-recognition of a foreign judgment in situations not expressly covered."2 Tradução: sentença estrangeira

24. in rem judgment – "An "in rem" judgment pertains to the property only, so it could be in your jurisdiction that they judicially foreclose (that is "go to court" and get a foreclosure judgment) and such proceedings are just against the property, not against you personally, so "in rem"."3 Tradução: sentença com obrigação de entrega de coisa ou valor

25. interlocutory judgment – "An interlocutory judgment is one given in the course of a cause, before final judgment."4 Tradução: decisão interlocutória

26. irregular judgment – "It is also clear from the authorities cited by Counsel for the Plaintiffs and for the Defendant that a judgment for too large a sum is an irregular judgment."5 Tradução: sentença viciada

27. judgment as matter of law "JMOL is similar to judgment on the pleadings and summary judgment, all of which test the factual sufficiency of a claim. Judgment on the pleadings is a motion made after pleading and before discovery; summary judgment happens after discovery and before trial; JMOL occurs during trial."6 Tradução: sentença que julga extinto o processo por falta de provas, sentença sem julgamento do mérito

28. judgment by confession – "Judgments by confession are controversial because of their summary nature and the lack of notice to debtors. A creditor need only have an attorney sign a confession of judgment to obtain a judgment by confession (assuming that the creditor has the right to such a judgment), and can do so without ever notifying the debtor."7 Tradução: sentença condenatória com base em confissão do réu

29. judgment by consent (ver agreed judgment, consent judgment)

30. judgment by nil dicit – "Judgment by nil dicit, is one rendered against a defendant for want of a plea. The plaintiff obtains a rule on the defendant to plead within a time specified, of which he serves a notice on the defendant or his attorney; if the defendant neglect to enter a plea within the time specified, the plaintiff may sign judgment against him."8 Tradução: julgamento à revelia
